1. Introduction Welcome to BuildBaseDigitally. By accessing our website and purchasing our services (“Service Plans,” “Digital Ecosystems,” “Automation Setup”), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, please do not use our services.

2. Services & Scope of Work

  • Deliverables: We will provide the services as described in your selected package (Starter, Business Expansion, or Digital Ecosystem).

  • Exclusions: Any feature, page, or functionality not explicitly mentioned in the package or proposal will be considered “Out of Scope” and may incur additional charges.

  • Third-Party Tools: We build systems using third-party tools (e.g., WordPress, n8n, OpenAI, WhatsApp API). We are not responsible for any changes in pricing, terms, or service interruptions caused by these third-party providers.

3. Payment Terms

  • Advance Payment: A non-refundable advance payment of 50% is required to begin any project.

  • Final Payment: The remaining 50% is due immediately upon project completion, before the final handover of credentials.

  • Late Fees: Failure to clear the final dues within 7 days of project completion may result in a temporary suspension of your website or automation services.

4. Refund & Cancellation Policy

  • No Refunds on Advance: Once the project has commenced (setup initiated), the 50% advance payment is non-refundable as it covers our time and resource allocation.

  • Cancellation by Client: If you cancel the project midway, you are not liable for the remaining balance, but the advance will be forfeited.

  • Cancellation by Us: If we are unable to complete the project due to our own fault, a full refund of the advance will be issued.

5. Client Responsibilities

  • Content: The Client must provide all necessary text, images, and logos within 7 days of the project start date. If content is delayed, the project timeline will be extended.

  • Approvals: The Client must provide feedback/approval on designs within 48 hours to ensure timely delivery.

  • Credentials: The Client must provide access to necessary accounts (Domain, Hosting, Social Media) for setup purposes.

6. Domain & Hosting

  • The charges for Domain Name and Web Hosting are not included in our package prices unless explicitly stated. The Client is responsible for purchasing and renewing these services directly from the provider.

7. Revisions

  • We offer 2 rounds of revisions during the design phase. Additional revisions or major structural changes after approval will be charged at an hourly rate.

8. Limitation of Liability

  • No Guarantees on Sales: While we build high-converting systems, BuildBaseDigitally does not guarantee a specific number of sales, leads, or business growth. Marketing results depend on market conditions and your product/service.

  • Data Loss: We are not liable for any data loss due to server failure, hacking, or third-party tool errors. We recommend keeping regular backups.

9. Governing Law

  • These terms shall be governed by and construed in accordance with the laws of India. Any disputes relating to these terms will be subject to the exclusive jurisdiction of the courts in Solan, Himachal Pradesh.
